Terms and Conditions for the use of driver licence checks on LicenceCheck.org

1. Introduction

These terms and conditions govern the use of LicenceCheck.org's Driving Licence Checking Service (the "Service"). By using the Service, you agree to be bound by these terms and conditions. If you do not agree to these terms and conditions, you may not use the Service.  

The Service is provided by Fleet Transport Consultants Ltd, trading as LicenceCheck.org, a company registered in England and Wales with its registered office at 11 Ouchthorpe Lane, Wakefield, WF1 3HS (the "Company").  

2. Definitions

In these terms and conditions, the following definitions apply:

  • "Account" means the customer-specific facility that will be set up within the LicenceCheck.org system by the Company as part of the customer sign-up process, which allows the customer access to the Service.  

  • "Customer" means the legal entity or person that purchases the Service.  

  • "Data Subject" means the individual employee, potential employee, or contractor whose driving licence information is provided by the Customer and is processed through the Service.  

  • "Driving Licence Check" means the checking of a Data Subject's driving licence information against the records held centrally by the Driver and Vehicle Licensing Agency (DVLA) for that individual.  

  • "Service" means the LicenceCheck.org system that is offered or made available to Customers, including any optional modules provided by the Company.  

3. Provision of the Service

3.1 The Company will provide the Service to the Customer in accordance with these terms and conditions.  

3.2 The Customer is responsible for ensuring that it has a minimum of one Solution Administrator who will be familiar with the use of the Service.  

3.3 The Company will provide the Customer with access to the Service on a 24/7 basis, subject to any scheduled maintenance or downtime.  

3.4 The Company does not warrant that the Service will be uninterrupted or error-free.  

3.5 The Company will not be liable for any loss or damage arising from any interruption or error in the Service.  

4. Use of the Service

4.1 The Customer may only use the Service for the purpose of conducting Driving Licence Checks on its employees, potential employees, or contractors.

4.2 The Customer may not use the Service for any other purpose, including but not limited to:

  • conducting Driving Licence Checks on individuals who are not employees, potential employees, or contractors of the Customer;

  • reselling or licensing the Service to any third party;

  • reverse engineering or decompiling the Service;

  • circumventing the security of the Service.

4.3 The Customer is responsible for ensuring that all Data Subjects have consented to the processing of their personal data in accordance with the Data Protection Act 2018 and the UK General Data Protection Regulation.

4.4 The Customer is responsible for maintaining the confidentiality of its Account and its password.

4.5 The Customer will notify the Company immediately of any unauthorized use of its Account or its password.

4.6 Password and User Management

  • The Customer is responsible for the creation and management of user accounts within their organization.

  • The Customer must ensure that login details are not shared between users.

  • Each user requiring access to the Service should have their own unique account.

  • The Customer may not allow access to the Service by anyone outside of their organization, including contractors, subcontractors, and suppliers.

  • The number of user accounts per organization is limited to three.

4.7 Security and ISO 27001 Certification

LicenceCheck.org is ISO 27001 certified, demonstrating our commitment to information security management systems (ISMS) best practices.

Our security practices align with this international standard, ensuring the confidentiality, integrity, and availability of your data.

5. Intellectual Property Rights

5.1 The Company owns all intellectual property rights in the Service.  

5.2 The Customer may not use the Company's intellectual property rights without the Company's prior written consent.  

6. Charges and Payment

6.1 The charges for the Service are set out on the Company's website.  

6.2 The Customer will pay the charges for the Service in accordance with the payment terms set out on the Company's website.  

6.3 The Company may suspend the Service if the Customer fails to pay the charges for the Service.  

7. Termination

7.1 The Company may terminate this Agreement immediately if the Customer breaches any of these terms and conditions.  

7.2 The Customer may terminate this Agreement at any time by giving the Company 30 days' written notice.  

7.3 Upon termination of this Agreement, the Customer will immediately cease using the Service.  

8. Limitation of Liability

8.1 The Company will not be liable for any loss or damage arising from the use of the Service, except to the extent that such loss or damage is caused by the Company's negligence or breach of these terms and conditions.  

8.2 The Company's total liability to the Customer under these terms and conditions will not exceed the amount of the charges paid by the Customer to the Company for the Service in the 12 months preceding the date on which the claim arose.  

9. Data Protection

9.1 The Company will comply with its obligations under the Data Protection Act 2018 and the UK General Data Protection Regulation in relation to the processing of personal data in connection with the Service.  

9.2 The Customer will comply with its obligations under the Data Protection Act 2018 and the UK General Data Protection Regulation in relation to the provision of personal data to the Company for processing in connection with the Service.  

10. Notices

10.1 All notices under these terms and conditions must be in writing and will be deemed to have been duly given when delivered personally, sent by first class post, or sent by email to the address of the other party as set out in these terms and conditions.  

11. Governing Law

11.1 These terms and conditions will be governed by and construed in accordance with the laws of England and Wales.  

12. Entire Agreement

12.1 These terms and conditions constitute the entire agreement between the parties in relation to the subject matter of these terms and conditions and supersede all previous agreements, representations, and understandings between the parties in relation to the subject matter of these terms and conditions.  

13. Waiver

13.1 No waiver of any provision of these terms and conditions will be effective unless in writing and signed by the party against whom the waiver is sought to be enforced.  

14. Severability

14.1 If any provision of these terms and conditions is held to be invalid or unenforceable, such provision will be struck out and the remaining provisions will remain in full force and effect.  

15. Third Party Rights

15.1 No person who is not a party to these terms and conditions will have any right under the Contracts (Rights of Third Parties) Act 1999 to enforce any provision of these terms and conditions.
